Terms of use

These Terms of Use ("Terms") govern your access to and use of the PulseAI Research platform, operated by Surfboats Solutions Private Limited ("Surfboats Solutions Private Limited," "we," "us," or "our"). By accessing or using PulseAI Research, you agree to comply with and be bound by these Terms, along with the Privacy Policy and any other policies or guidelines incorporated by reference. If you do not agree to these Terms, you should not use PulseAI Research.

1. Eligibility and Access

PulseAI Research is accessible to all individuals and organizations, with no upfront involvement or obligation from Smytten, except for the provision of the Smytten user base ("Smytten Audience") for audience targeting. PulseAI Research's role is limited solely to providing the relevant data for surveys, and does not extend to any other involvement in survey creation, management, or execution. Users of PulseAI Research are solely responsible for the content, execution, and analysis of their surveys. By using the platform, users acknowledge and agree to these terms.

2. Survey Creation Process

The PulseAI Research platform allows users to create surveys by interacting with the AI-powered bot. The user is expected to share their research objective with the bot. The bot then engages in a conversation with the user to refine the research goal, methodology, and survey structure. The survey creation process includes unlimited iterations, where users can either manually modify the survey or continue to converse with the bot to refine the content. Once the survey is finalized, PulseAI Research proceeds to share the survey with the Smytten Audience for data collection.

3. Audience Selection and Survey Administration

The survey will be administered to the Smytten Audience, which includes users within the Smytten platform. Audience targeting is based on the user data shared with Smytten, including engagement, behavioral, and purchase patterns. Only users within the Smytten Audience are eligible for participation in these surveys. The will suggest an audience based on the provided research objectives, but the user may also manually select their audience within the Smytten user base. The survey will be executed on the PulseAI Research platform, and any inappropriate content or topics deemed unsuitable for the audience will lead to rejection or manual intervention.

4. Rejection of Surveys

PulseAI Research reserves the right to reject or stop the execution of surveys if the content or topic is deemed unsuitable for its audience. If a survey is rejected, users will be notified during the audience selection phase, and the survey will undergo manual review. In such cases, users will receive a full refund for any payments made.

5. Data Collection and Analysis

Once survey responses are collected, the data will be analyzed using machine intelligence and made available to the user (survey creator). The user can engage with the bot to explore insights or view the data from different perspectives. The user will also have the option to export raw data and insights for future use.

6. Limited Use

The User agrees not to reverse engineer, modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information or software obtained through the platform. Limited reproduction and copying of the content are allowed only with PulseAI Research's name as the source and prior written consent. The reproduction or modification of content for commercial or non-commercial purposes is prohibited unless expressly authorized. All content, whether publicly posted or privately transmitted, is the sole responsibility of the person who originated it. PulseAI Research cannot and does not guarantee the accuracy, legality, or appropriateness of any content posted by users. Use of any content or materials posted via platform is at your own risk.

7. User Warranty and Representation

You warrant and represent that you own or have the necessary licenses to use and distribute all content that you submit or authorize us to use. You further guarantee that the content you submit does not infringe the intellectual property rights or any other rights of third parties. You acknowledge that no legal proceedings or investigations have been instituted or threatened related to the content you use in connection with the Services provided by the platform.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PulseAI Research SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES;
  • ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES, INCLUDING DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF OTHER USERS OR THIRD PARTIES;
  • ANY CONTENT OBTAINED THROUGH THE SERVICES; OR
  • UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

9. Indemnification

You agree to indemnify, defend, and hold harmless PulseAI Research, its affiliates, and partners from and against any and all losses, liabilities, claims, damages, costs, and expenses (including legal fees and disbursements) arising from any breach of these Terms, including but not limited to the infringement of intellectual property rights, third-party rights, or non-performance of any representation, warranty, or covenant under these Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Ahmedabad, India.

11. Prohibited Uses

You agree not to use the platform in any way that:

  • is unlawful, illegal, or unauthorized;
  • is defamatory of any person or entity;
  • is obscene, offensive, or abusive;
  • promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age;
  • infringes upon the copyright, database rights, or trademarks of others;
  • is likely to harass, upset, embarrass, alarm, or annoy others;
  • disrupts the Services or interferes with the use and enjoyment of the platform by other users;
  • advocates, promotes, or assists in the commission of unlawful acts, including copyright infringement or computer misuse.

12. Additional Legal Requirements

This document is an electronic record in terms of the Information Technology Act, 2000, and the rules thereunder as applicable. This electronic record is generated by a computer system and does not require any physical or digital signature. This document is published in accordance with the provisions of Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011, which require publishing the rules and regulations, privacy policy, and terms of use for access or usage of this platform. The platform is owned and controlled by Surfboats Solutions Private Limited, a company incorporated under the Companies Act, 2013, with its registered office at Smytten B-1007 B-1008, 10th Floor, Titanium Square, Thaltej Cross Roads, Thaltej, Ahmedabad - 380054, Gujarat.

13. Changes to Terms

PulseAI Research reserves the right to modify or update these Terms at any time. Any changes to the Terms will be posted on the platform, and the updated Terms will be effective immediately upon posting. By continuing to use the platform after such changes are made, you agree to the revised Terms.

14. Disclaimers

The platform is provided on an "as-is" basis, and we do not make any representations or warranties regarding its functionality, reliability, or availability. PulseAI Research makes no guarantees regarding the accuracy, completeness, or performance of any content or services provided through the platform.

15. Termination of Use

PulseAI Research reserves the right to terminate your access to the Services at any time, without notice, for any reason, including if you violate these Terms or engage in prohibited activities. By using the PulseAI Research platform, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use. If you do not agree with these Terms, you must cease using the platform immediately.
